GENERAL TERMS OF AGREEMENT
If you are a retail store or distributor, to qualify for wholesale/distributor purchases, you must be a valid retail business and by agreeing to our order policy and our terms and conditions you certify that you are such and have proper licensing within your state. You are only authorized to sell through the retail store(s) that you have listed. Secondary stores must receive prior written approval.
Please note that Whomp It Glass does not engage in dropshipping or sell to online-only stores. The only exception to online sales is for authorized distributors.
AGE RESTRICTION
All Whomp It products are intended to be sold to and used by individuals 21 years of age or older. If you are younger than 21, please leave this site immediately. If you are a store that sells Whomp It products in person, we require that you verify the age of every customer using a valid, unexpired photo ID. If you sell Whomp It products online, we require that you verify age prior to check out.

PRODUCT OFFERING
Upon wholesale/distributor application approval, you will be contacted by a Sales Representative and receive our catalog. We may conduct the sale through email or over the phone, and you will need to provide the same information listed under the "Account Requirements" section of this policy. If an item is out of stock, it is marked as Sold Out on the catalog. We do not accept backorders for sold out items. However, you can request a back in stock alert from the product page on our website. If you select "Notify Me When Available" and enter your email, you'll receive an automatic response when that product is restocked.

We do not ship wholesale orders to PO boxes of any kind.
MINIMUM ORDER AMOUNT
The minimum order amount for wholesale orders is $250. The minimum order amount for distributor orders is $500. Individual items do not have minimum order quantities.
PAYMENT INFORMATION
Whompitglass.com accepts VISA, Mastercard, American Express, JCB, Discover, and Diners Club credit and debit cards. If the payment authorization fails, your order will not go through and you’ll be prompted to re-enter the card information or provide an alternative form of payment. No orders will be processed or shipped until full payment is received. If you have opted for installment payments, the order will not be processed or shipped until the initial payment is received.
If a transaction fails due to an AVS error, please double check the zip code you’ve entered in your billing address is the zip code associated with that credit card. If your card fails the AVS or CVV checks, you may see the pre-authorization appear on your credit card statement as a pending charge. The pending charge will fall off your statement after 3-5 business days.

WHOLESALE ORDERS - We offer FREE standard shipping for wholesale orders of $999 or more. For continental USA orders under this minimum, calculated shipping will be applied. We ship all orders from our facility in Boca Raton, FL.
Delivery to Alaska and Hawaii - Wholesale orders over $999 ship for FREE. Add $24.95 onto the standard calculated delivery charge for orders that do not meet the free shipping minimum.

Delivery to Alaska and Hawaii - Orders over $100 ship for FREE. Add $8 onto the standard flat rate delivery charge for orders $100 or less.
Tracking information will be provided once the order has shipped.
Please note that the shipping time does not include the processing time for packaging and creating orders. Most orders are shipped within 3 business days and arrive within 7 days of shipment. There may be exceptions to this depending on stock.
Any problems with order goods must be reported by email within 3 days of delivery. You cannot return goods until you have received a written authorization from Whomp It. Goods sent back without written authorization will not be credited to your account.
PRICING
After application approval, we will send a wholesale or distributor catalog with pricing. Every product will display its current wholesale or distributor price. This price is subject to change throughout the year.
If you distribute Whomp It products to other retailers, you must sell them at our exact wholesale pricing.
The Minimum Advertised Price (MAP) of our products is equal to the sale prices on whompitglass.com. The MAP of our products is subject to change throughout the year. When selling Whomp It products in a brick and mortar store, you must sell them at or above the minimum advertised pricing unless otherwise approved in writing by Whomp It. Distributors are the only ones authorized to conduct online sales, and they must match our wholesale pricing exactly. Additionally, distributors must provide the stores they supply with our MAP, and those stores must adhere to the MAP.
Occasionally, there may be bundles and specials that are only available to wholesale/distributor accounts. The MAP still applies to each individual product in the bundle.
RESELLER OBLIGATIONS
Distributors are responsible for ensuring that all stores to which they sell Whomp It products comply with the terms outlined in this agreement, including but not limited to adherence to Minimum Advertised Pricing (MAP) policies, age verification requirements, and authorized retail channels (i.e., brick-and-mortar stores). Distributors must communicate these terms to the stores and provide proof of compliance upon request.
COMMUNICATION OF TERMS TO END CONSUMERS
Wholesale and retail stores that purchase Whomp It products are required to communicate Whomp It’s terms of use, including age restrictions, product use disclaimers, and any other relevant policies, to their end customers. This can be done through clear in-store signage, online terms, or other appropriate means. Failure to communicate these terms may result in termination of the wholesale agreement.
ORDER MODIFICATION & CANCELATION
If you need to cancel or change your order (including changes to products ordered, payment information, and address details), please contact us immediately at contact@whompitglass.com. If your order ships before the cancellation or change is processed, you will still be charged and you must return the items for a refund in accordance with our return policies. We will not accept returns after 30 days from original delivery.

REPLACEMENT POLICY
At Whomp It, we take great pride in our stringent quality control measures and high packaging standards. It's rare for our products to arrive damaged. However, in the unlikely event that you receive a damaged, defective, or incorrect item, please consult our Replacement Policy for the most effective resolution process.
CREDITS
If a claim results in a credit (instead of a refund or replacement), the credit will be issued as a discount code. The discount code can be used to purchase any products available on whompitglass.com.
LIMITATION OF LIABILITY
In no case shall Whomp It, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

The videos on our socials are made to demonstrate the strength of our products, but DO NOT attempt to replicate the actions in our videos and DO NOT attempt to destroy our products. We are not responsible for any property damage or bodily injury resulting from the use of our products. Retailer/Distributor agrees that they will not sell Whomp It products after they have been used, this includes products that have been used for demonstration purposes.
